1. PURCHASE ORDER

• Acceptance of Terms: The order or purchase of any Supercar Experiences Inc. product or service indicates that you have read, understood, and accepted the below-stated Terms of Use.
• Service Variability: Supercar Experiences Inc. offers a diverse range of information and services through our website. Each service may have its distinct registration procedures, terms, and conditions.
• International Purchases: If you choose to purchase Supercar Experiences Inc. products from outside Canada, you do so on your own initiative and are accountable for compliance with local laws and regulations. All prices are in Canadian dollars.
• SCE Gift Card: SCE Gift Cards purchased directly from Supercar Experiences Inc., on September 1st, 2019, and onward, never expire. They are non-refundable but can be transferred to another party, provided all requirements are met.

2. DRIVING EXPERIENCE & RIDE ALONG CONDITIONS

• Age & License Requirements: Drivers participating in the private drive exotics must be at least 18 years of age with a valid G2 driver's license or international driver's license. Passengers must be at least 7 years old.
• Documentation: A valid Driver’s License must be presented on the day of the experience for verification purposes.
• Liability Waiver: All participants must sign our Adult Release and Waiver of Liability, Assumption of Risk, and Indemnity Agreement before the event. This waiver acknowledges the inherent risks of driving high-performance supercars and releases Supercar Experiences Inc. from any liabilities arising from their participation.

3. RESERVATION & BOOKING

• Mandatory Reservations: Reservations are required for all driving events. In the event of a cancellation or no-show, payments are non-refundable but can be transferred to another party meeting the qualification requirements.
• Rebooking Fee: A rebooking fee of $70 applies for any changes made to the reservation. Changes must be made at least 14 days before the scheduled event. After this period, participants are required to either attend as scheduled or send a substitute in their behalf.
• Event Changes: If not enough seats are booked for a drive, Supercar Experiences Inc. reserves the right to reschedule participants to another day to ensure the best experience with the most cars available. Dates are subject to change without notice. Supercar Experiences Inc. is not responsible for any travel expenses incurred due to unforeseen changes.

4. INCLEMENT WEATHER & FORCE MAJEURE POLICY

• Weather Conditions: Supercar Experiences Inc. prioritizes safety. Adverse weather conditions may lead to the postponement or cancellation of a drive.
• Event Cancellation & Rescheduling: In the event of unforeseen circumstances, including adverse weather or force majeure, Supercar Experiences Inc. reserves the right to reschedule or modify the drive.

5. PRICE & PAYMENT CONDITIONS

• Pricing: Prices listed on our platforms are before any applicable tax. Supercar Experiences Inc. reserves the right to modify its prices without notice.
• Payment: Full payment is required to validate a reservation. Supercar Experiences Inc. accepts various payment methods for the convenience of its customers.

6. LIABILITY & CODE OF CONDUCT

• Speeding and Impoundment: The Driver acknowledges that any speeding, especially at rates of 40-50 km/h over the posted limit, may result in the vehicle being impounded by the police. In the event of impoundment due to the Driver's actions, the Driver agrees to cover all associated costs, including potential downtime costs which may amount to up to $15,000.
• Driving Behavior: "Slingshotting", defined as intentionally slowing down the vehicle to later accelerate rapidly, is strictly prohibited. Such behavior can lead to dangerous situations and potential accidents. The Driver agrees to avoid creating dangerous situations. If the Driver is found to be endangering the group or the drive, the Company reserves the right to halt the drive immediately. Continued dangerous behavior will result in the Driver forfeiting their right to continue in the supercar.
• Liability for Damages: The Driver is held liable for any at-fault damages to the Supercars during the duration of the private drive.
• Guidance and Communication: The Driver agrees to remain attentive and vigilant at all times during the drive. Roads can be unpredictable, and unforeseen situations may arise. The Driver must listen and adhere to all instructions provided by the Supercar Experiences' Crew Members, especially when communicated via walkie-talkie or other communication devices. Failure to adhere to guidance from the Company's crew members may result in the termination of the Driver's participation.
• Indemnification: The Driver agrees to indemnify and hold harmless Supercar Experiences, its owners, employees, officers, and agents, from any and all claims, demands, suits, damages, or liability of any kind, including reasonable attorney's fees, arising from or related to the Driver's participation in the drive. This includes, but is not limited to, any claims by third parties arising from the Driver's actions or omissions.
• Additional Provisions: The Driver acknowledges that driving a supercar requires heightened attention and skill. The Driver agrees to operate the vehicle in a safe and lawful manner at all times. The Driver agrees not to operate the vehicle under the influence of alcohol, drugs, or any other substances that may impair judgment or reaction times. The Driver acknowledges that the roads are shared with other users and agrees to respect all traffic laws and regulations.
• Extra Passenger: Drivers are allowed to bring an extra passenger for the private drive. However, the passenger must pay the associated cost and is strictly prohibited from driving. They can only participate as a passenger.
